Privacy e trattamento dati personali

Ai sensi dell’articolo 13 del Decreto Legislativo 30 giugno 2003, n. 196 “Codice in materia di protezione dei dati personali” (di seguito anche solo il “Codice”) e dell’articolo 13 del Regolamento (UE) 2016/679, recante disposizioni a protezione delle persone fisiche con riguardo al trattamento dei dati personali e alla libera circolazione di tali dati, (di seguito anche solo il “GDPR”) Le forniamo, qui di seguito, l’informativa riguardante il trattamento dei Suoi dati personali che sarà effettuato da W0W Srls nel rispetto altresì delle prescrizioni fornite dal Garante per la Protezione dei Dati Personali (di seguito anche solo il “Garante Privacy”) con i provvedimenti adottati in materia di programmi di vendita e informazione dei propri prodotti e servizi e fidelizzazione dei propri clienti.

La W0W Srl unipersonale con socio unico e i suoi siti non eseguono alcuna attività di profilazione o di marketing ad eccezione di quanto strettamente necessario per la gestione degli ordini e dei servizi oppure di quanto richiesto dai clienti, una volta concesso il loro consenso, per i servizi relativi all’invio di newsletter, di email promozionali, di estratti documentali richiesti dal cliente oppure di servizi B2B, HORECA o di B2B/HORECA/franchising.

 

1. Titolare del trattamento dei dati personali

Il Titolare del trattamento è W0W Srl unipersonale con socio unico (P.IVA 02417880222) con sede in Trento (TN), Italia, Via Silvio Pegoretti 4, tel. 3516507879, email “[email protected]” oppure “[email protected]”.

 

2. Categorie di dati personali trattati

2.1. Dati personali forniti da Lei volontariamente per finalizzare le attività di vendita on-line o telefonica oppure B2B/HORECA/franchising

Nell’ambito del processo di trattamento dei dati personali saranno trattati i Suoi dati personali forniti da Lei direttamente. Per dato personale si intende “qualsiasi informazione riguardante una persona fisica identificata o identificabile («interessato»); si considera identificabile la persona fisica che può essere identificata, direttamente o indirettamente, con particolare riferimento a un identificativo come il nome, un numero di identificazione, dati relativi all’ubicazione, un identificativo online o a uno o più elementi caratteristici della sua identità fisica, fisiologica, genetica, psichica, economica, culturale o sociale” e le immagini (art. 4 par. 1 n. 1 del GDPR).

 

2.2. Dati personali di terzi da Lei forniti volontariamente per finalizzare le attività di vendita on-line o telefonica oppure B2B/HORECA/franchising

Lei prende atto che la eventuale indicazione di dati personali e di contatto di qualsiasi altro soggetto, che opera a vario titolo nell’ambito del rapporto contrattuale con Lei in essere, rappresenta un trattamento di dati personali rispetto al quale Lei si pone come titolare del trattamento dei dati personali dei predetti soggetti. Pertanto, Lei, nella qualità di Titolare del trattamento dei dati personali e di contatto garantirà che i dati personali e di contatto dei predetti soggetti sono stati raccolti e comunicati in conformità con le disposizioni vigenti in materia privacy. A tal fine si impegna ex art. 13 del Codice ed ex art. 13 del GDPR a informare i predetti soggetti i cui dati personali sono raccolti e comunicati in relazione alle modalità e finalità del trattamento. I dati personali dei predetti soggetti saranno comunicati al solo scopo di finalizzare le attività e i servizi di vendita on-line o telefonica oppure B2B/HORECA/franchising.

 

3. Finalità del trattamento dei dati personali

I Suoi dati personali potranno essere trattati, con il Suo preventivo esplicito consenso ove necessario, per le seguenti finalità.

 

3.1. Finalizzare le attività di vendita on-line o telefonica oppure B2B/HORECA/franchising

I Suoi dati personali saranno trattati per l’esecuzione e la corretta gestione dei Suoi preventivi, ordini, spedizioni e fatture. Per i servizi relativi al B2B/HORECA/franchising o per i servizi relativi all’invio di newsletter o email promozionali solo dopo il consenso del cliente espresso tramite dei moduli elettronici.

3.2. Informazione sui prodotti in vendita, promozioni, newsletter, documenti per B2B/HORECA/franchising

Il trattamento (inclusa la conservazione successiva) anche di dati – diversi dai dati personali – ossia ad esempio dati relativi al volume di spesa globale progressivamente realizzato senza comunque riferimenti di dettaglio ai singoli prodotti e/o servizi acquistati sarà effettuato per l’attribuzione di vantaggi connessi all’elaborazione di promozioni e per il tempo a ciò strettamente necessario. L’eventuale conservazione di dati di dettaglio relativi alle particolari tipologie di beni e servizi acquistati, o ai vantaggi conseguiti (sconti, omaggi, ecc.), sarà effettuata solo nei casi in cui sia strettamente necessaria per l’elaborazione di promozioni comunicate con newsletter alle quali gli interessati possono cancellarsi facendo clic sulla disiscrizione al momento della ricezione via email della newsletter stessa. Lo stesso è valido anche per il B2B/HORECA/franchising.

 

4. Base giuridica del trattamento dei dati personali

La base giuridica del trattamento dei dati personali per le finalità di cui ai paragrafi 3.1 (Finalizzare le attività di vendita on-line o telefonica) e 3.2 (Informazione sui prodotti in vendita, promozioni e newsletter) è il contratto di cui Lei è parte al fine di poter acquisire prodotti e servizi dalla W0W Srl unipersonale con socio unico e suoi siti come “www.zeroalcol.com”.

Il conferimento dei Suoi dati personali per le predette finalità è facoltativo, tuttavia, il mancato conferimento dei Suoi dati personali comporterà l’impossibilità per Lei di effettuare acquisti o ricevere servizi dalla W0W Srl unipersonale con socio unico e dai suoi siti come www.zeroalcol.com e l’impossibilità per il Titolare del trattamento di inviarLe messaggi pubblicitari e promozionali tramite la newsletter o email.

Le precisiamo, inoltre, che laddove Lei abbia prestato il consenso per autorizzare il Titolare del trattamento a perseguire le finalità di cui ai paragrafi 3.1 (Finalizzare le attività di vendita on-line o telefonica oppure B2B/HORECA/franchising) e 3.2 (Informazione sui prodotti in vendita, promozioni, newsletter, B2B/HORECA/franchising), resterà comunque libero in ogni momento di revocare il consenso e/o di opporsi al trattamento dei dati per le predette finalità, inviando senza alcuna formalità una chiara comunicazione scritta in tal senso ai recapiti meglio specificati al paragrafo 10 “Contatti per l’esercizio dei diritti dell’interessato e per ulteriori informazioni” che segue.

A seguito della ricezione di tale richiesta di revoca e/o di opposizione sarà cura del Titolare del trattamento procedere tempestivamente alla rimozione e cancellazione dei Suoi dati personali dai database e informare, ove possibile, per le medesime finalità di cancellazione eventuali terzi cui i dati siano stati comunicati.

 

5. Modalità del trattamento dei dati personali

Il trattamento dei Suoi dati personali avverrà mediante strumenti informatici e telematici, nonché talvolta anche cartacei.

I dati personali da Lei forniti non saranno oggetto di cessione a terzi o sottoposti a processi decisionali automatizzati di profilazione e/o marketing. Nel caso questo si renda necessario per ottemperare ad una sua specifica richiesta di qualunque genere, non potrà avvenire senza suo ulteriore consenso con specifica richiesta per ogni singolo utilizzo.

 

6. Destinatari dei dati personali

I Suoi dati personali – che non saranno oggetto di diffusione – potranno essere comunicati a:

  1. agenti o collaboratori commerciali incaricati della W0W Srl unipersonale con socio unico di svolgere attività strettamente correlate allo svolgimento di servizi di invio ordini, spedizioni, promozione e sollecitazione commerciale e pubblicitaria che si trovano sul territorio dell’Unione Europea;
  2. soggetti delegati e/o incaricati della W0W Srl unipersonale con socio unico di svolgere attività strettamente correlate allo svolgimento di servizi di invio ordini, spedizioni, promozione e sollecitazione commerciale e pubblicitaria che si trovano sul territorio dell’Unione Europea;
  3. società collegate al sito “www.zeroalcol.com” per le attività di gestione delle vendite, spedizioni, resi e per l’invio della newsletter;
  4. persone, società o studi professionali che prestano attività di assistenza e consulenza alla W0W Srl unipersonale con socio unico in materia contabile, amministrativa, legale, tributaria e finanziaria che sono dislocati sul territorio dell’Unione Europea;
  5. soggetti, enti od autorità a cui la comunicazione dei Suoi dati personali sia obbligatoria in forza di disposizioni di legge o di ordini delle autorità.

I soggetti o le categorie di soggetti ai quali i Suoi dati personali saranno comunicati potranno trattarli in qualità di responsabili del trattamento, di titolari autonomi del trattamento o di contitolari del trattamento.

L’elenco completo dei responsabili del trattamento è disponibile presso la sede del Titolare del trattamento cui potrà inviare, per ottenere maggiori informazioni, una richiesta scritta o via email ai recapiti indicati al paragrafo 10 “Contatti per l’esercizio dei diritti dell’interessato e per ulteriori informazioni” che segue.

 

7. Trasferimento dei dati personali extra UE

I Suoi dati personali non sono e non saranno trasferiti fuori dall’Unione Europea.

 

8. Tempi di conservazione dei dati personali

I Suoi dati personali per le finalità di cui ai paragrafi 3.1 (Finalizzare le attività di vendita on-line o telefonica) e 3.2 (Informazione sui prodotti in vendita, promozioni e newsletter) saranno trattati e conservati fino al momento della cancellazione richiesta da Lei stesso proprietario dei dati oppure a seguito di operazioni di pulizia periodiche degli archivi informatici previo comunicazione indirizzata a Lei circa la cancellazione di suoi dati, salvo il caso di specifici obblighi di legge per la conservazione di documentazione contabile o fiscale, o comunque sempre fino a che non intervenga la cancellazione e/o la disdetta da parte Sua.

 

9. Esercizio dei diritti da parte dell’interessato

Ai sensi dell’articolo 7 del Codice nonché ai sensi degli articoli 13, comma 2, lettere (b) e (d) e degli articoli da 15 a 22 del GDPR, La informiamo che:

  • Lei ha il diritto di chiedere a W0W Srl unipersonale con socio unico l’accesso ai dati personali, la rettifica o la cancellazione degli stessi o la limitazione del trattamento che lo riguardano o di opporsi al loro trattamento, o di revocare il consenso ove prestato, oltre al diritto alla portabilità dei dati;
  • Lei ha il diritto di proporre un reclamo al Garante Privacy, seguendo le procedure e le indicazioni pubblicate sul sito web ufficiale del Garante Privacy medesimo su www.garanteprivacy.it;
  • le eventuali rettifiche o cancellazioni o limitazioni del trattamento effettuate su Sua richiesta – salvo che ciò si riveli impossibile o implichi uno sforzo sproporzionato per la W0W Srl unipersonale con socio unico – saranno comunicate da W0W Srls a ciascuno dei destinatari cui sono stati trasmessi i Suoi dati personali.

Le Sue richieste per l’esercizio dei Suoi diritti dovranno essere rivolte per iscritto al Titolare del trattamento ai recapiti indicati nel paragrafo 10 “Contatti per l’esercizio dei diritti dell’interessato e per ulteriori informazioni” che segue.

L’esercizio dei diritti non è soggetto ad alcun vincolo di forma ed è gratuito.

Per utilità è riportato integralmente di seguito il testo dell’articolo 7 del Codice:

Art. 7. Diritto di accesso ai dati personali ed altri diritti

  1. L’interessato ha diritto di ottenere la conferma dell’esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile.
  2. L’interessato ha diritto di ottenere l’indicazione:

a) dell’origine dei dati personali; 

b) delle finalità e modalità del trattamento;

c) della logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici;

d) degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai sensi dell’articolo 5, comma 2;

 e) dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato, di responsabili o incaricati.

 

3. L’interessato ha diritto di ottenere:

 a) l’aggiornamento, la rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati;

 b) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;

 c) l’attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.

 

 4. L’interessato ha diritto di opporsi, in tutto o in parte:

a) per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta;

 b) al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.

10. Integrità e riservatezza dei dati personali

Al fine di salvaguardare la privacy e l’integrità dei dati degli utenti, le informazioni relative agli account dei clienti sono protette da password. W0W Srl unipersonale con socio unico non è in grado di conoscere tali password e può solo resettarle su richiesta espressa dell’interessato proprietario dei dati personali per attività connesse alla gestione delle vendite, del servizio clienti e dei servizi di B2B/HORECA/franchising. W0W Srl unipersonale con socio unico non è in grado di conoscere i dati di pagamento dei clienti in quanto i sistemi di pagamento non sono connessi ai siti di proprietà della W0W Srl unipersonale con socio unico che si limita a reindirizzare i clienti ai sistemi di pagamenti di terzi per completare le procedure di vendita. Attualmente i siti di proprietà della W0W Srl unipersonale con socio unico, per eseguire le normali procedure attività di vendita, spedizione, assistenza, informazione ai clienti, servizi di B2B/HORECA/franchising, sono collegati ai seguenti sistemi di terzi che hanno dichiarato di osservare e rispettare la normativa privacy del “GDPR” Regolamento (UE) 2016/679:
